1. Acceptance of these Terms
By creating an account, signing in, or otherwise using DietPoint (the “App,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions and our Privacy practices. If you do not agree, do not create an account or use the App. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
2. The App is informational, not medical or professional advice
DietPoint provides general food discovery, meal ideas, nutrition estimates, price estimates, and dietary tagging for convenience only. Nothing in the App is medical, nutritional, dietetic, allergen, health, or professional advice. We are not physicians, dietitians, or allergists. Always consult a qualified healthcare professional before starting, changing, or stopping any diet, or if you have a medical condition, food allergy, or dietary restriction.
3. No guarantee of accuracy — nutrition, prices, allergens, and availability
All nutrition values (calories, protein, fat, carbs, net carbs, sodium, etc.), portion sizes, prices, ingredient lists, diet tags, and allergen information shown in the App are estimates compiled from public guides, averages, and (for some chain restaurants) publicly published data. They may be wrong, outdated, or inapplicable to your location. Prices, menus, recipes, ingredients, and availability vary by location and change frequently. We do not guarantee that any item, value, or tag is correct or current.
4. Allergens and cross-contact — you must verify independently
Allergen and cross-contact information can change and is often not fully known, especially for local restaurants and home-cooked recipes. Never rely solely on the App to determine whether a food is safe for an allergy or sensitivity. Always confirm ingredients, preparation methods, and cross-contact risk directly with the restaurant, manufacturer, or product label before eating. Severe or life-threatening allergic reactions are possible; the responsibility to verify is yours.
5. Assumption of risk
You use the App and rely on any information, meal idea, or restaurant suggestion entirely at your own risk. You are responsible for your own food choices, health outcomes, purchases, and any reactions or consequences that may result from following or acting on anything in the App.
6. No warranty
The App and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including any warranty of accuracy, reliability, fitness for a particular purpose, or non-infringement. We do not warrant the App will be uninterrupted, error-free, secure, or that any information is correct.
7. Limitation of liability
To the fullest extent permitted by law, DietPoint, its owners, operators, employees, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of any kind (including health-related harm, allergic reaction, overpayment, data loss, or loss of profits) arising out of or related to your use of, or inability to use, the App or any information, suggestion, estimate, or link provided through it, even if advised of the possibility of such damages.
8. Indemnification
You agree to indemnify and hold harmless DietPoint and its owners, operators, employees, affiliates, and licensors from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of your use of the App, your reliance on any information in it, your violation of these Terms, or your infringement of any third-party rights.
9. Third-party services and links
The App may link to or integrate with third-party services such as DoorDash, Google, restaurant websites, mapping services, and AI providers. We do not control and are not responsible for the content, availability, pricing, safety, quality, privacy practices, or accuracy of any third-party service. Your use of those services is subject to their own terms and policies, and any transaction or interaction with them is solely between you and that third party.
10. AI-generated content
Some meal ideas and suggestions may be generated or assisted by artificial intelligence. AI output can be incorrect, unsafe, or inappropriate for your specific dietary or health needs. Treat all AI-generated content as a starting point only and verify everything independently before preparing or consuming any food.
11. Your account and conduct
You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information, not to misuse the App, not to attempt to access data or systems you are not authorized to access, and not to use the App for any unlawful or harmful purpose. You must be of legal age to use the App and to accept these Terms.
12. Privacy
Your use of the App is also governed by our privacy practices. We handle account and preference data as described in the App. By using the App you consent to such handling.
13. Changes to the App and these Terms
We may update, modify, suspend, or discontinue the App, any feature, or these Terms at any time without notice. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the App is operated, without regard to conflict-of-law principles. Any dispute arising out of or relating to the App or these Terms shall be resolved in the courts of that jurisdiction, and you consent to its exclusive jurisdiction.
15. Entire agreement and severability
These Terms constitute the entire agreement between you and DietPoint regarding the App. If any provision is found unenforceable, the remaining provisions remain in full effect.
